The Poison Control Center Chat (“Poison Control Center Chat”) is a web-based communication service sponsored by The Children’s Hospital of Philadelphia (“CHOP”). Use of Poison Control Center Chat is subject to this this Poison Control Center Chat Consent and Acknowledgement. By clicking on and connecting to Poison Control Center Chat, you certify that you agree to the terms of this Consent and Acknowledgement. You further agree that clicking on and connecting to Poison Control Center Chat shall constitute your digital signature to this written Consent and Acknowledgement.
I acknowledge and agree to the following:
1. Poison Control Center Chat is a web-based interactive chat technology service that connects CHOP licensed clinical staff with residents of Southeastern Pennsylvania and Delaware so that they may access poison control services. The chat technology does not include video or audio. Poison Control Center Chat is not intended to create any practitioner-patient relationship, or constitute the practice of or furnishing of medical, nursing, pharmacy, or professional healthcare advice, diagnosis, consultation, or treatment services in any jurisdiction. Please be advised that there may be limitations to the services provided through Poison Control Center Chat as Poison Control Center Chat is limited to chat functionality only and does not allow for physical interactions between the patient and practitioner. POISON CONTROL CENTER CHAT SHOULD NOT BE USED IF YOU, YOUR CHLID, OR YOUR PATIENT REQUIRES EMERGENCY SERVICES. IF YOU, YOU CHILD, OR THE PATIENT REQUIRES EMERGENCY CARE, PLEASE CALL 911 OR VISIT YOUR LOCAL EMERGENCY SERVICES PROVIDER.
2. CHOP or the licensed clinical staff member must collect certain information from you. Any information that you provide to the licensed clinical staff member or CHOP related to the visit must be truthful, accurate, complete and updated health information, or the quality and effectiveness of the services provided may be affected.
3. The decision to participate in a Poison Control Center Chat is voluntary, meaning you can choose to end the use of Poison Control Center Chat at any time and request an available alternative. CHOP may also end a chat encounter or your use of Poison Control Center Chat for any reason including, but not limited to, the licensed clinical staff member’s decision that the patient should be seen in person; your or the patient’s unwillingness or inability to properly use Poison Control Center Chat, or concerns about the equipment.
4. Poison Control Center Chat is subject to the CHOP HIPAA Notice of Privacy Practices, Privacy Policy, and CHOP website Terms of Use.
5. CHOP complies with the law and best industry practices to provide for the security of a Poison Control Center Chat encounter. However, no system can perfectly guard against risks such as a breach caused by an intentional intrusion, inadvertent disclosure of information, or the failures or limitations of equipment used to transmit relevant data that could cause delays in or the inability to provide evaluation or treatment. In addition, Poison Control Center Chat is provided to you by CHOP in collaboration with Salesforce, a third-party technology vendor. CHOP is not responsible for the actions or omissions of such third-party vendors. CHOP disclaims any responsibility for or liability related to the actions or omissions of such third-party vendors.
6. POISON CONTROL CENTER CHAT IS PROVIDED BY CHOP ON AN “AS IS” BASIS. CHOP MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED AS TO THE OPERATION OF CHOP POISON CONTROL CENTER CHAT, OR THE CONTENT, PRODUCTS AND/OR SERVICES INCLUDED. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, CHOP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND/OR INFRINGEMENT. Poison Control Center Chat may not be available to you at all times due to system failures, procedures, maintenance or other causes beyond CHOP’s control. Access to Poison Control Center Chat is provided as an "as-is, as-available" basis and CHOP does not guarantee that you will be able to use Poison Control Center Chat at any particular time. During times when Poison Control Center Chat is unavailable, other communication methods (e.g., telephone) should be used.
7. The Poison Control Center Chat is not directed at children under 13 (even if the patient is under 13). This means that if you are accessing the Poison Control Center Chat on behalf of the patient who is under 13, you are considered to be the exclusive user of Poison Control Center Chat, and any and all information provided on Poison Control Center Chat on behalf of the patient is provided solely by you.
